Terms and conditions

Welcome to the car rental experience

1. Requirements and documents needed for rental:

The minimum age to rent is 21 years (they can rent between 18 and 20 years, paying the young driver charge) completed on the date of delivery of the vehicle

Present a validly issued and valid Identity Card or Passport for a minimum of 30 days after the return date of the vehicle.

Present a valid Driver’s License for driving the type of vehicle reserved and valid for a minimum of 30 days after the return date of the vehicle.

Present a valid credit card in the name of the lessee to grant the corresponding guarantee.

A pre-authorization will be made on the customer’s credit card as a guarantee of the rental.

The rental will be charged at the time of picking up the vehicle.

All required documents must be in good condition and not manipulated and/or intervened.

2. Rental Reservation:

Lucky Team SpA (hereinafter as “Hertz Chile”), does not confirm model, color, fuel type or specific brand of vehicle, only category.

Hertz Chile will keep the vehicle reserved for rental for a maximum period of 45 minutes after the time indicated in the reservation or until the closing time of the corresponding Hertz Chile branch, whichever occurs first. Otherwise, it will be understood that the customer has waived the rental of the vehicle (No Show), so Hertz Chile may dispose, at its discretion, of the vehicle to be rented to other people.

No refunds or returns are made for unused days or for non-compliance with the rental requirements.

3. Rental Guarantee:

Prior to the delivery of the vehicle, and together with the signing of the rental contract, the customer must provide Hertz Chile with a guarantee to respond to the payment of the services.

The guarantee must be granted through a personal Bank Credit Card of the customer who signs the rental contract.

The following are not accepted as a means of guaranteeing the rental: third party credit cards, prepaid credit cards, debit cards, virtual cards, checks, cash or other documents to guarantee the rental. Only credit cards.

In case the reservation is prepaid, a guarantee must also be left through a Credit Card to withdraw the vehicle, as indicated in this same point.

The amount of the guarantee will depend on the category of the rented vehicle and the agreed payment method. The value of the guarantee will be informed prior to the rental.

The lessee expressly authorizes the lessor to fully or partially and without further formalities the guarantee, and to dispose of it in order to impute it to the payment of the amounts owed by the lessee, whose concept originates in the vehicle rental contract. In case the guarantee is not sufficient to cover the amounts owed, the lessee expressly authorizes the lessor to make a new retention on the bank credit card to fully satisfy the amount owed. The payment of the balances or sums owed may be pursued by extrajudicial or judicial means, by personnel dependent on the lessor or by deputies for collection and the collection costs will be borne by the debtor.

4. The base rate includes:

Roadside Assistance in case of mechanical failure not attributable to negligence of the lessee, within the national territory.

Rate includes T/km (time and mileage) + Basic Coverage (CDW and DAT). The CDW coverage includes the payment of a deductible by the lessee. The coverages are detailed in point N°7.

One day of vehicle rental considers 24 hours counted from the start time of the contract.

Hertz Chile allows a maximum delay of 1 hour for the return of the vehicle without additional charge. For any delivery with a delay, an extra charge will be charged.

5. Prepaid return conditions web reservations:

Applies only to prepaid reservations made online directly on the Hertz Chile website. To make the cancellation and refund of reservations with online prepayment effective, the following must be considered:

Cancellation with 10 or more days in advance: 100% of the refundable payment.

Cancellation between 7 and 9 days in advance: 50% of the refundable payment.

Cancellation less than or equal to 6 days in advance: Non-refundable.

No refunds will be made in case of prepaid NO SHOW reservations, nor in reservations and/or contracts for prepaid rental days not used. Additionally, if the reservation is modified and there is a balance in favor for any reason, this amount will be credited for future reservations at Hertz Chile as the case may be.

For cases where there is a refund, as declared above, the amount will be refunded to the same credit card of the holder who made the payment within approximately 15 business days counted from the date the request was sent via email.

The final return date to the bank account will depend on the issuing bank of the credit card.

In case of having paid with a debit card, a transfer will be made to your bank checking account of the person who contracted and paid for the service via the web. The final return date to the bank checking account will be within a maximum period of 15 business days counted from the date the request was sent via email.

To request the cancellation and/or refunds of a reservation with WEB Prepayment, an email must be sent to reservas@hertz.cl informing of this cancellation with the following information (reservation number and the data of the person requesting the cancellation; full name, Rut, telephone, email and if it is for transfer the following is required; name of the Bank, account type, account number, RUT, telephone and confirmation email). If Hertz Chile does not receive this request by this means with the indicated information, it will not be able to carry out the requested management. In case of canceling your reservation directly on our website, you must also send the email as indicated above.

6. Coverages:

All the coverages mentioned below will apply only within the Chilean territory and will not be applicable in case of negligence, fault or fraud by the lessee and/or driver of the vehicle. Additionally, the coverages are not applicable in case of faults and/or violations of the current traffic regulations in the Republic of Chile.

The base rental rate includes Basic Coverage, that is:

The additional coverages available are:

Plus Cover: Reduces the deductible for partial and collision damage by 100% - Maintains deductible for rollover, Airbags, damage from attempted theft (Locks and glasses), Partial and/or total theft or theft of the vehicle.

Full Cover: Eliminates 100% deductibles for partial, collision, rollover, locks, glasses and accessories on the occasion of theft. Maintains deductible for theft or theft of the vehicle.

Regarding the additional coverages are not enabled for outside Chile, this means if a customer contracts additional coverages these only apply in national territory (Chile).

7. Additional equipment:

Additional services or equipment are subject to availability and have an associated charge.

Hertz Chile is not responsible for additional services or equipment that have not been confirmed in the reservation.

8. Accident:

In case of accident, theft or robbery of the vehicle, the respective sworn statement of accident and/or complaint in Carabineros de Chile must be completed, as appropriate. In case there are no injured third parties, the lessee must make a simple sworn statement at the nearest Hertz Chile office detailing the circumstances of the accident within 24 hours of the events.

In case there are injured third parties, it is mandatory to immediately go to the nearest Carabineros de Chile police station to make the complaint and immediately notify Hertz Chile. If the events occur outside of business hours, you must immediately notify by calling our roadside assistance phone number indicated on our website.

For the statement before Hertz Chile, all information regarding the events that occurred must be provided, including the name, Rut and telephone number of any third party involved, as well as the License Plate, brand, model and insurance company of the vehicles involved. Likewise, photographs of the place and vehicles will be requested, which show the damages produced.

If the lessee does not comply with the procedure established previously, the full amount of the damages, both of the vehicle and of third parties, will be charged to the credit card indicated in the rental contract. Likewise, depending on the contracted coverages, charges will be made for claims.

9. Loss or loss of documentation of the rented vehicle:

In case of loss or loss of the vehicle documents (Padrón, Circulation Permit, SOAP, Homologation Certificate or Technical Review) an additional charge of $ 35,000 + VAT will be applied.

In the case of loss of license plate, a charge of $ 45,000 + VAT will be made corresponding to administrative procedures on this concept.

10. Fuel:

The vehicles are delivered with a full fuel tank, and must be returned in the same conditions, so the level of the tank is declared in the Vehicle Reception Act. The value for the fuel charge service up to the level at which the vehicle was delivered will be: $1,450 + VAT per liter for vehicles with Diesel engine and $1,660 + VAT per liter for vehicles with Gasoline engine.

For those cases in which a different fuel is loaded than required by the vehicle (diesel instead of gasoline or vice versa), all costs associated with the cleaning of the tank, the engine or other damages produced, so that the vehicle remains operational, will be the responsibility and charge of the lessee. Likewise, the corresponding charge for the fuel loading service previously expressed will be made.

11. Airport fee:

A surcharge of 9% of the total rental price will be applied when the vehicle is picked up from an airport.

12. Televía (TAG) charge:

The rental rate indicated in your quote, Reservation and/or Contract does not include the payment of the TAG service (televía service to travel on concessioned highways). This charge is made at the end of the rental contract according to the use that the vehicle has during this period.

All Hertz Chile units are enabled to travel on Concessioned highways and tolls that are enabled with TAG system as well as highways with “Free Flow” system.

In case of manual payment by the customer on any highway, you must prove this with the payment receipt(s) to make the respective discount since the system will make the charge. Without the receipt there is no refund or return.

13. International permit (Exit to Argentina):

The permit to travel to Argentina with a vehicle from Hertz Chile must be requested with a minimum advance of 7 business days from the start date of the rental. For the above, all the information required by Hertz Chile for obtaining the permit must be provided. Once the permit is approved by Hertz Chile, the required documentation for the trip (notarial permit, mandatory insurance and Customs form for departure) will be delivered to the lessee.

Argentine nationals may not request this permit, unless they prove their permanent residence for more than one year in Chile, through a certificate issued by the respective consulate.

The permit has a cost, which must be pre-paid for the processing through credit card and/or electronic transfer. There will be no refund in case the lessee does not materialize the rental of the vehicle or does not make the trip to Argentina.

If the permit is requested for a trip to Argentina for a period between 1 to 4 days, $200,000 + VAT will be charged, from 5 to 15 days, $100,000 + VAT will be charged and between 16 to 30 days, $130,000 + VAT will be charged. The requested permit includes the insurance required by Mercosur, which exclusively covers damages caused to third parties.

Regarding the rental coverages, check point 7 of coverages where this is detailed.

In case of delay in the return of the vehicle, the lessee continues to be responsible for it and the contract will remain in force until the unit is received at any Hertz office in Chile. In case it is necessary to incur costs of transfers, crane services, customs fines, additional rental days, etc., these will be borne by the lessee.

14. Roadside assistance service (cranes):

In case the roadside assistance service (cranes) is required for reasons attributable to driving or misuse of the vehicle (battery charging, collision, rollovers, door opening, tire change, etc.), this will be borne by the lessee. If the crane requirement originates from a mechanical failure, not attributable to driving, the service will be borne by the lessor.

For the request of this service, the lessee must call the 24-hour roadside assistance phone, indicated on the vehicle keychain and in the rental contract.

15. No Show:

Reservations with payment at Branch:

Hertz Chile will keep the vehicle reserved for rental for a maximum period of 45 minutes after the time indicated in the reservation or until the closing time of the corresponding Hertz Chile branch, whichever occurs first. Otherwise, it will be understood that the customer has waived the rental of the vehicle (No Show), so Hertz Chile may dispose, at its discretion, of the vehicle to be rented to other people.

Prepaid Reservations:

Hertz Chile will keep the vehicle reserved for rental for a maximum period of 2 hours after the time indicated in the reservation or until the closing time of the corresponding Hertz Chile branch, whichever occurs first. Otherwise, it will be understood that the customer has waived the rental of the vehicle (No Show), so Hertz Chile may dispose, at its discretion, of the vehicle to be rented to other people.

In the case of prepaid reservations, the reservation will be in a pending web state so that the customer can use the amount of that reservation in a new request which must be used within the next 6 months from the date the reservation is in a pending web state.

16. Vehicle Delivery:

The lessee declares to receive the vehicle in perfect mechanical condition, bodywork, with its accessories and enabled TAG or Televía electronic device, with license plate, circulation permit, mandatory insurance and technical review, all current and according to the Vehicle Delivery/Reception Act. In addition, the lessee declares to have verified that the rented vehicle has the necessary accessories according to the current traffic legal regulations, as well as detailed in the Vehicle Delivery/Reception Act that the lessee has signed at the time of receiving the vehicle.

In case an additional accessory is required such as a child seat, this cannot be installed by Hertz Chile staff. Parents or guardians of the child must personally perform the installation, thus ensuring the safety of the child.

Force Majeure: In case of prohibition of circulation of the leased vehicle determined by undersecretaries, intendancy, Ministry of Transport, the government or other competent authority or entity, which implies restrictions for certain license plates, Hertz Chile is not responsible for the days not used, nor is it obliged to replace the vehicle involved. The extra expenses that such prohibition or restriction may cause (expenses for transfers, parking, etc.) will be borne by the lessee.

17. Return of the Vehicle:

The lessee must return the vehicle in the same conditions in which it was delivered, according to the information indicated in the Delivery/Reception form, which is signed by the lessee at the time of receiving the vehicle.

If the lessee returns the vehicle outside of Hertz Chile office hours or without the vehicle being received by a Hertz Chile collaborator, using the key box, the vehicle inspection will be carried out later and the Reception Act will be sent to the lessee by email. Considering that the vehicle was not received by Hertz Chile staff, the lessee must photograph the dashboard (especially at the fuel level) and the exterior of the vehicle on all sides.

The differences between delivery and return, which are not covered by the contracted coverages, will be charged to the lessee.

It is the responsibility of the lessee to remove all personal items from the vehicle and Hertz Chile is not responsible for the loss or loss of these.

In any case, if the vehicle is not returned on time and form, whatever the situation or circumstance, the lessee will be prohibited from using the vehicle, understanding that from that moment it is used without the knowledge or authorization of its owner, being the sole responsibility of the lessee for the facts or acts that occur, without prejudice to the lessor’s right to report misappropriation or theft of the vehicle, or to exercise any legal action that corresponds in law.

18. Fines and Damages:

The lessee is responsible for all sanctions, penalties or fines that originate or derive from infractions to the traffic laws or other laws, regulations, ordinances, instructions of Carabineros de Chile or other applicable regulations during the rental period. In this way, irrevocably authorizes Hertz Chile, to charge the credit card registered as a guarantee at the beginning of the rental contract, all fines attributable to the lessee, even when such fines are known by the lessor after the date of return of the rented vehicle.

Likewise, the lessee is responsible for all damages and losses caused to the vehicle or to persons or property of third parties, due to the negligent use of the vehicle or contrary to the manufacturer’s recommendations. Consequently, irrevocably authorizes Hertz Chile, to charge the credit card registered as a guarantee at the beginning of the rental contract, all amounts for damages or losses attributable to the lessee duly accredited.

19. Drop off charges table:

An additional charge will be made when the rented vehicle is returned to a city different from the one where it was picked up. Vehicles can only be returned to one of the offices indicated on the Hertz Chile website under the Rent a Car section.

The charge for the Drop Off at a different point will be charged according to the distance between the pick-up and drop-off points according to the following table:

from km to 250km: $ 70,000 + VAT

from 251km to 450km: $ 120,000 + VAT

from 451km to 800km: $ 180,000 + VAT

from 801km to 1200km: $ 250,000 + VAT

from 1201km to 1600km: $ 350,000 + VAT

from 1601km to 2000km: $ 460,000 + VAT

Over 2001km: $ 460,000 + VAT

For vehicles that are returned in the Punta Arenas, Coyhaique and Balmaceda area, an additional amount of $ 800,000 + VAT must be considered.

On the other hand, if the vehicle is rented in any of these 3 areas (Punta Arenas, Coyhaique and Balmaceda) and returned to any other city between Arica and Puerto Montt, an amount of $ 800,000 + VAT must be considered and additionally the section of the table that corresponds according to the mileage of the final city of the return of the vehicle.

20. Additional Driver:

It is necessary to register Additional Drivers, presenting valid Driver’s License and Identity Card, before making the rental and individualizing them in the rental contract.

In case of an accident and the driver of the rented vehicle at that time is not one of the drivers declared in the rental contract, the coverages will be ineffective, the lessee being fully responsible for the loss of the vehicle and all damages and/or losses caused to the vehicle and/or third parties.

The above, will be applicable in all those cases in which an accident or loss of the vehicle occurs while it is in the possession of an unauthorized third party by the lessor.

21. National Tax (VAT):

The Value Added Tax is applied on the total of the contracted services and currently corresponds to 19%.

22. Return of dirty vehicles:

If the vehicle is returned with strong odors, cigarette smell, excess mud, animal hair, spilled food or liquids, which dirty or stain the upholstery, a surcharge will be made for cleaning it. Likewise, the lessor may charge an additional rental day for the cleaning work required, in case the circumstances warrant it.

23. Text messages (SMS) and Whatsapp (Wsp):

By making a reservation, the lessee is expressly accepting that informative text messages (SMS) and/or Whatsapp (Wsp) can be sent as a normal part of the vehicle reservation and rental process. Each lessee may request not to receive informative text messages (SMS) and/or Whatsapp (Wsp) by sending an email to reservas@hertz.cl indicating that he/she does not wish to continue receiving such messages along with the cell phone number where he/she receives the messages.

24. Identity verification:

At the time of contracting the vehicle rental services, Hertz Chile will verify the identity of the lessee, with the mechanisms available, in compliance with the Privacy and Confidentiality Policy of the Information, and with the applicable legal regulations, that is, Law N° 19.496 on Protection of Consumer Rights, Law N° 19.628 on The Protection of Privacy, and Law N° 20.575 that establishes the Principle of Purpose in the Treatment of Personal Data.

The terms indicated are of a general nature, the lessor reserving the right to establish particular and/or special conditions in the rental contract.

25. Prohibitions:

The lessee is expressly prohibited from the following:

Allow the vehicle to be driven by any person not declared in the rental contract.

Destine it to paid transport or use as a public or private passenger transport vehicle.

Sublease the rented vehicle or assign its use to third parties not declared in the rental contract. In this case, the lessee will be responsible for the acts of his dependents as his own and under any circumstances when the vehicle suffers any accident or causes damage to the lessor or third parties while being driven by unauthorized persons in the manner mentioned above.

Make repairs, alterations and/or modifications of any kind to the vehicle without the lessor’s consent.

Destine them to cargo transport that exceeds the maximum capacity defined by the manufacturer. Likewise, it cannot be used in illegal activities, to tow or push another vehicle or to tow trailers.

Drive the rented vehicle under the influence of drugs, narcotics, alcohol influence and/or drunkenness; likewise, the driver of the rented vehicle is prohibited from refusing to undergo the breathalyzer test or another that corresponds, once required by the competent authority.

Drive the contracted vehicle without a valid driver’s license and for the type of rented vehicle. Likewise, you must keep in the vehicle the documentation required by the traffic law to circulate, which is provided by Hertz Chile at the time of delivery of the vehicle, which will be recorded in the Delivery Act.

Leave the vehicle from the national territory, except that it has previously obtained the international permit from Hertz Chile.

Manipulate, remove or disassemble the Televía (TAG) device, or any other part or accessory of the vehicle.

Travel through areas or places that are not roads enabled by the competent authorities. In the case of single traction vehicles, transit on unpaved and/or unpaved roads is prohibited.

Abandon the vehicle in case of failures, accidents or any other cause. In this case, the lessee must call the roadside assistance service and coordinate the towing of the vehicle, being obliged to wait for the vehicle to be removed according to the instructions given by this service.

Drive the vehicle without being attentive to traffic conditions, negligently or contrary to the use recommended by the manufacturer or current legal and traffic regulations.

26. Time Off (Delivery outside of Hours):

This term is used for deliveries contracted outside the service hours defined by Hertz Chile at its airports in Chile.

The service hours defined by Hertz for its service points where there is a Counter at Airports is from Monday to Sunday from 07.30 to 22.00 hrs., if the delivery of the vehicle is outside this service hours, Hertz Chile will charge a service called “Time Off”, delivery outside the established hours and the amount to be charged will be $ 30,000 + VAT.

In case the flight is delayed and the lessee arrives after the service hours defined and informed by Hertz Chile, the extra charge indicated in this point will be made.

28. Miscellaneous:

The terms indicated are of a general nature, the lessor reserving the right to establish particular and/or special conditions in the rental contract. These Terms and Conditions will be applied and understood to be incorporated into each of the contracts entered into by Hertz Chile. The use of this website, the application of these Terms and Conditions, the acts performed and the contracts entered into through this website are subject to and subject to the laws of the Republic of Chile.
